Indiana Governor Mike Pence is about to sign a bill that will end nearly all abortions in-state. Last week, HB 1337 was approved by the Indiana legislature .
The legislation is another unconstitutional anti-choice TRAP (Targeted Regulation of Abortion Providers) laws that will essentially ban abortion and place an undue burden on women seeking to have a safe and legal procedure. It requires women who get the procedure to pay for the burial or cremation of the fetus. Men, however, will not be required to hold a funeral for their sperm each time they wack off.
It also requires the fetal ultrasound mandating that women listen to the heartbeat before proceeding with the abortion. It’s pure manipulation and intimidation of women who are already making a potentially difficult decision. If that isn’t bad enough, it requires the ultrasound be performed 18 hours prior to the procedure, so women have to do two trips to the clinic. Since there are only four counties out of 92 that have clinics it means most will have to travel a long way or stay overnight for the waiting period to elapse.
Like the Texas abortion law that is currently being considered by the Supreme Court, the Indiana law requires each clinic to have a doctor that has admitting privileges at a state hospital. This makes it difficult for visiting doctors to come in to help women or for doctors who don’t work at hospitals but who can legally perform the procedure to be able to perform a legal procedure.
Finally, the worst part of this bill says that a woman will be forced to carry the child even if it is not able to function or live.
Prohibits a person from performing an abortion if the person knows that the pregnant woman is seeking the abortion solely because of: (1) the race, color, national origin, ancestry, or sex of the fetus; or (2) a diagnosis or potential diagnosis of the fetus having Down syndrome or any other disability. Provides for disciplinary sanctions and civil liability for wrongful death if a person knowingly or intentionally performs a sex selective abortion or an abortion conducted because of a diagnosis or potential diagnosis of Down syndrome or any other disability.
This leaves only a few loopholes left for women. If you’re the victim of rape or incest or you might die you should be able to still have the procedure, but you’ll be forced to listen to the heartbeat and pay for the casket and funeral for the fetus.
Not enough people are paying attention to this and in all of the Democratic debates, no questions have been focused on protecting a woman’s right to choose her own health care decisions without intrusion from the government.
